Terms of Service

Effective September 17, 2026

1. The service

CodeFracture is an infrastructure platform operated by Sapelo AI (“CodeFracture”, “we”). It builds container images from code you provide, runs them on compute we manage, routes traffic to them, and stores the logs, metrics and traces they emit. These terms govern every account, API key and workload on the platform.

2. Accounts and organizations

An account belongs to one organization (a “tenant”). The person who creates the organization is its owner and is responsible for everyone they invite, for every API key minted under it, and for every agent that acts with those keys. Keep credentials secret; anything done with a valid credential is done by your organization.

3. Your code and your data

You keep every right to the code, images, secrets and data you bring to CodeFracture. You grant us only what is needed to run the service: to build, store, execute and route your workloads, and to retain their telemetry for the period your plan allows. We do not read your data except to operate the platform, to respond to a support request you make, or as the law requires.

4. Acceptable use

You agree not to use CodeFracture to:

  • attack, probe or degrade systems you are not authorized to test;
  • send unsolicited bulk messages or host content that is unlawful where you or we operate;
  • mine cryptocurrency or otherwise consume compute beyond what your plan provides;
  • circumvent isolation between tenants, quotas, rate limits or billing.

We may cordon, stop or suspend a workload or tenant that breaches these rules, and we will tell you why.

5. Availability and changes

CodeFracture is provided as is. We work to keep it available and to keep your deployments serving through rollouts, but we do not promise uninterrupted service, and we may change or retire features with notice through the console or by email. Public API contracts change additively; breaking changes are versioned.

6. Fees

Paid plans are billed as shown in the console at the time of purchase. Usage-based charges are metered by the platform and invoiced in arrears. Unpaid invoices may lead to limits being enforced on the organization and, after notice, to suspension.

7. Termination

You may close your organization at any time from the console. Closing it schedules a purge of every workload, artifact, secret and record it owns; the purge is irreversible once it runs. We may terminate an organization for a material breach of these terms, and will give you a reasonable opportunity to export your data first unless the breach makes that unsafe.

8. Liability

To the extent the law allows, CodeFracture is not liable for indirect, incidental or consequential loss, and our total liability for any claim is limited to the fees you paid us in the twelve months before the claim arose.

9. Contact

Questions about these terms go to legal@sapelo.ai. Our handling of personal data is described in the Privacy Policy.
